wanted to know, how much land her father owned out of a 100 acre tract her grandfather had deeded.
I reluctantly agreed to do the search. Upon completion, I had to break the news to her, that her father only had a Divided Interest.
My search revealed, that in the mid 70's, her grandfather deeded the 100ac to his 11 children. The deed did NOT state that is was being conveyed
as Rights-Of- Survivorship. Seven of the Eleven children were now deceased, meaning title passed to THEIR HEIRS, not the surviving siblings.
Anyone who purchases ANY portion of this 100ac, is going to have to do a QUIET TITLE suit on it.
Needless to say, a title search prior to buying, could have save a couple thousand dollars in UN-necessary expense.
